Terms of sale and use

1. Scope and provider

These terms apply to the use of the question card game “Couple Cards” (the “game”) and to buying the full version. The game is provided by Simon Marko Johan – PromptLab, Magnus-Niedermair-Str. 11, 89407 Dillingen a.d. Donau, Germany (“we”, “us”). The game is intended only for people aged 18 and over.

2. What you get

The game is a digital card game with conversation questions for couples that runs in your web browser. Without buying, you can play 10 cards for free (free sample). The full version includes all 11 decks with 500+ questions in the respective language, including a deck of sexual questions intended for adults only. The game is for entertainment and conversation. It is not counseling and not a substitute for therapy.

3. How the contract is made

“Continue to payment” takes you to Stripe’s payment page, where you see the product and final price again and can correct your details. Clicking the pay button on the Stripe page places a binding order with an obligation to pay; the contract is concluded when payment succeeds. You get access to the full version immediately afterwards. The contract language is English.

4. Price and payment processing by Link

The price is $4.99, charged once. It is a final price that includes any sales tax or VAT that applies. There is no subscription and there are no further charges. Payment is handled through Stripe Managed Payments: Link (“Sold through Link”, a Stripe group service) acts as the reseller, collects the price, handles taxes, sends your receipt and deals with refunds and payment disputes. Link’s terms (link.com/terms) also apply to the payment. This does not affect your rights under these terms and the law, including your right of withdrawal and your statutory warranty rights; for anything about the game itself, we are your point of contact. If the payment page offers you the price in another currency, the amount shown there applies.

5. Access

After buying, you receive a personal access link by email and on the confirmation page. Access has no time limit, needs no password and works on multiple devices. You can request a fresh link at any time via “Restore access”, sent to the email address used for the purchase. Please keep the link private: you may share it with your partner, but not publicly or with third parties. If a link is obviously misused (for example posted publicly), we may block it and send you a new one. Should we ever shut the game down permanently, we will announce this at least three months in advance on the website and by email.

6. License

You receive a simple, non-transferable right to use the game for private, non-commercial purposes. The questions are protected by copyright; copying or publishing them, even in part, requires our permission.

7. Right of withdrawal

You have a 14-day right of withdrawal, wherever you live. Details are in the cancellation policy. The easiest way is the “Withdraw from contract” button at the bottom of every page. We do not ask you to waive this right: the full 14 days apply even if you have already started playing.

8. Warranty and updates

Statutory rights for defects in digital products apply. We provide updates needed to keep the game in conformity with the contract and may improve or extend content as long as this does not substantially reduce the scope of the full version.

9. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under product liability law. For slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer protection rules remain unaffected.

10. Disputes and governing law

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection laws of your country of residence still apply.
